1. Introduction
Welcome to mycity.property (“Platform”, “We”, “Our”, “Us”). These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, including Owners, Buyers, Sellers, Tenants, Agents, Brokers) and the Platform. By accessing or using our services, you agree to be bound by these Terms.
If you do not agree, you must not use our services.
2. Nature of Service (Strict Definition)
The Platform is a property listing and lead generation facilitator only.
We:
Publish property listings
Generate and route enquiries (leads)
Coordinate property visits via our executives or third-party brokers
We DO NOT:
Act as a real estate agent/broker for every transaction
Guarantee deal closure, pricing, or timelines
Verify legal ownership, titles, or documentation
Participate in or control negotiations or financial transactions
All transactions are strictly between the respective parties.
3. No Warranty / No Representation
The Platform makes no warranties or representations, express or implied, regarding:
Accuracy, completeness, or legality of listings
Identity, credibility, or intent of any user
Market value, pricing, or property condition
Users acknowledge that all information is provided on an “as-is” and “as-available” basis.
4. Mandatory Due Diligence
All Users expressly agree to:
Independently verify ownership, title, approvals, and legal status
Conduct financial, technical, and legal due diligence
Consult legal/financial advisors where required
Failure to do so shall be at the sole risk and liability of the User.
5. Payment Terms (Binding & Enforceable)
The Platform operates on a “No Deal, No Payment” model; however:
5.1 Trigger for Payment Obligation
A payment obligation is deemed triggered when:
A transaction is concluded directly or indirectly
Parties introduced via our Platform complete a deal within 12 months of lead sharing
5.2 Rental Transactions
If shown by our executive: Tenant shall pay 1 to 1.5 months’ rent
If shown by broker: Charges as per agreed broker arrangement
5.3 Sale Transactions
If handled by our executive: Buyer and Seller each pay 2% of transaction value (or as agreed in writing)
If handled by broker: Charges as per agreement
5.4 Commission Protection Clause
Users cannot bypass the Platform to avoid payment. Any direct or indirect deal between connected parties shall still attract full service charges.
5.5 Non-Payment Consequences
In case of non-payment:
Platform reserves the right to initiate legal recovery
Interest may be charged on outstanding dues
User may be blacklisted and restricted from future services
All payments, once due, are non-refundable.
6. Lead Ownership & Non-Circumvention
All leads generated are the exclusive property of the Platform
Users shall not share, resell, misuse, or circulate leads
Any attempt to bypass the Platform will be treated as a material breach
7. Contact Sharing & Consent
Contact details are shared only after consent
Once shared, the Platform is not liable for misuse, harassment, or unauthorized communication
8. Property Visits & Charges
Property Owners, Agents, or Brokers:
Cannot charge for property visits without explicit prior consent
Any violation shall be solely their responsibility
9. User Conduct & Obligations
Users shall NOT:
Provide false, misleading, or fraudulent information
Engage in unlawful, unethical, or deceptive practices
Harass, threaten, or misuse contact data
Violation may result in immediate termination and legal action.
10. Absolute Limitation of Liability
To the maximum extent permitted by law, the Platform shall not be liable for:
Fraud, misrepresentation, or cheating by any party
Any financial loss, damages, or missed opportunities
Title disputes, legal defects, or regulatory violations
Delayed, failed, or cancelled transactions
Any indirect, incidental, or consequential damages
Users agree that they use the Platform entirely at their own risk.
11. Indemnity (Strong Protection Clause)
Users agree to fully indemnify, defend, and hold harmless the Platform, its owners, employees, and affiliates from:
Any claims, losses, damages, or legal actions
Any disputes arising between Users
Any regulatory or legal violations by Users
This obligation survives termination of use.
12. No Accounts / Controlled Access
The Platform does not provide user account creation
All interactions are managed via internal systems or representatives
13. Right to Suspend / Terminate
We reserve absolute rights to:
Remove listings without notice
Deny or restrict access
Suspend any user for suspicious or non-compliant activity
14. Data Privacy & Usage
Data is used for lead generation and service facilitation
We do not share data without consent
Post-consent sharing, the Platform bears no liability for misuse
15. Dispute Resolution (Mandatory)
Users must attempt amicable resolution first
Failing which, disputes shall be resolved via binding arbitration
Arbitration Terms:
Seat & Venue: Pune, Maharashtra
Language: English
Decision of arbitrator shall be final and binding
16. Jurisdiction Clause
All legal matters shall fall under the exclusive jurisdiction of courts in Pune, Maharashtra, India.
17. Force Majeure
The Platform shall not be liable for failure or delay due to events beyond control, including but not limited to natural disasters, government actions, technical failures, or network issues.
18. Modifications
We reserve the right to update these Terms at any time. Continued use constitutes acceptance of revised Terms.
